The Brazilian Federal Constitution establishes the dignity of the human person (art. 1º, III) as the foundation of the Democratic State of Law, as well as the right to health and the protection of motherhood and childhood (art. 6º) as social rights. These provisions support the promotion of humanized obstetric care, which is part of the fundamental right to health, guaranteed by the Unified Health System (SUS). Public policies such as the Humanization of Prenatal and Birth Program (PHPN), the Comprehensive Assistance Program for Women's Health (PAISM) and the Stork Network structure national guidelines for humanized practices. However, the increasing enactment of state and municipal laws on the subject since 2014 motivates the analysis of this legislative phenomenon. Based on the premise that legislation on humanization cannot be analyzed in isolation, but must be understood in light of public health policies – state instruments that address problems such as maternal mortality, high rates of cesarean sections, and violations of women's rights in health care facilities – this study seeks to answer the following question: “To what extent do state laws that address the right to humanization of obstetric care interact with the public health policies of the Federative Republic of Brazil?” To this end, the study aimed to analyze the relationship between these state laws that specifically address the right to humanization of obstetric care and the public health policies of the State. The research used a qualitative approach, document analysis, and survey of state legislation. Discursive textual analysis was applied to interpret the connections between state and federal regulations. The results indicate that the state laws analyzed generally have an implicit alignment with federal public policies, reflecting the principles of humanization, promotion of maternal health, and respect for the dignity of pregnant women. However, it was identified that some of these state laws reproduce other norms, with identical or very similar texts, suggesting a greater concern with legislative productivity or with symbolic laws, especially when they disregard the local context of care. On the other hand, legislative innovations stand out in states such as Maranhão (2023) and Piauí (2022), which incorporate intersectional aspects and promote anti-racist and non-transphobic policies, expanding the guarantee of rights in obstetric care. It is concluded that, despite the limitations, state laws play a relevant role in expanding the debate and protecting the rights of pregnant women, although they need to be updated. The study highlights the need for greater integration between federal and state regulations and suggests the potential for future research.
