Abstract: From the categories of crimes prescribed in the Law number 9.605/1998 – Law of Environmental Crimes – and in the Federal Decree number6.514/2008, the infractions against the flora in the Brazilian states present higher averages in too many categories, which demands furtherinvestigation into the types of breaches registered by environmental inspections. The present study has the objective to diagnose and analyzethe environmental breaches committed against the flora in the regions of the Baixo Amazonas and Tapajos, in the state of Pará, registeredfrom the period of 2009-2018, by the State Secretary of the Environment and Sustainability. Bibliographic and documental searches weredone in 767 breaches drawn up against the flora between 2009- 2018 in 19 municipalities in the areas of study. The results showed thatSantarem and Novo Progresso were the municipalities with the most environmental infractions against the flora in the Baixo Amazonas andTapajos region, respectively. The type of breach with the greatest occurrence was the deforestation and destruction of vegetation. Areas of„Legal Reserve‟ and „Areas of Permanent Preservation‟ were the most affected by the illegal deforestation. Approximately 59% of thebreaches enforced were incidences over the area of the deforestation of a size of less than 5 hectares. Besides this around 50% of thebreaches occurred in privately owned land and the citizens were the principle offenders against the flora. In this way the study re enforces thatthe forests, one of the principal Amazonian Resources, creates a severely threatened environment. That being said, the presence of the stateshould be intense in 2 ways: to incentivize and guarantee the environmental sustainability to realize greater inspections in the areasresearched
metadata.dc.description.resumo: Das categorias de crimes previstas na Lei nº 9.605/1998 - Lei de Crimes Ambientais - e no Decreto Federal nº 6.514/2008, as infrações contra a flora nos estados brasileiros apresentam médias superiores às demais categorias, o que demanda maior investigação acerca das tipologias infracionais registradas pela fiscalização ambiental. O presente estudo tem como objetivo diagnosticar e analisar as infrações ambientais cometidas contra a flora nas regiões do Baixo Amazonas e Tapajós, no estado do Pará, registradas no período entre 2009 e2018, pela Secretaria de Estado de Meio Ambiente e Sustentabilidade. Para tanto, foram realizadas pesquisas bibliográfica e documental em767 autos de infração lavrados contra a flora no período de 2009 a 2018, em 19 municípios das regiões em estudo. Os resultados apontaram que Santarém e Novo Progresso foram os municípios com maior autuação ambiental contra a flora na região do Baixo Amazonas e Tapajós, respectivamente. A tipologia infracional de maior ocorrência foi o desmatamento/destruição da vegetação. Áreas de Reserva Legal e Áreas de Preservação Permanente foram as mais afetadas pelo desmatamento ilegal. Aproximadamente 59% (n=270) dos autos de infração aplicados incidiram sobre polígonos de desmatamento de tamanho menor que 5 ha. Além disso, cerca de 50% (n= 339) das infrações ocorreram em propriedades privadas e as pessoas físicas despontaram como as principais infratoras contra a flora. Neste sentido, o estudo reforça que as florestas, um dos principais recursos amazônicos, perfaz um ambiente severamente ameaçado. Dessa forma, a presença doestado deve ser intensa em dois sentidos: de incentivar e garantir a sustentabilidade ambiental a de realizar maior fiscalização ostensiva nas áreas pesquisadas.
