A eficácia do acesso ao sistema interamericano através do peticionamento individual por mulheres vítimas de violações de direitos humanos

Abstract

This paper aimed to analyze the effectiveness of the access to the Inter-American System by individual petitions for women victims of human rights violations. To this end, it was characterized and analyzed the functioning of the Inter-American System of Human Rights, as well as the level of difficulty in submitting an individual petition, with regard to the necessary conditions and requirements; the individual procedural steps; and the international human rights of women and their impact on the Brazilian legal system, based on the research problem “to what extent is the individual petition of the Inter-American System effective in terms of access for women victims of human rights violations?, and on the hypotheses whether the access is or is not effective when it comes to the level of difficulty imposed by the requirements and conditions established by the Organization of American States, as well as if the procedural process takes a short or a long period of time to be completed. Thus, according to the documental analysis and bibliographical research, it was noticed a great demand for technical and formal knowledge about the individual petition, as well as a long and difficult-to-access procedural process. Furthermore, the research was intended to highlight a complementary protection mechanism of Human Rights at international level that can be accessed by women in search of reparation for any violation of rights by their own State, as well as to cause reflection and debate on the theme in order to bring information and contribute to a greater participation of women at a international stage.
